Redemption and Discharge of Mortgage in Singapore

Redemption of Mortgage in Singapore: Quick Answer #

Short answer: redemption of mortgage means you repay your housing loan in full. Your bank then signs a discharge of the mortgage. First, you serve a redemption notice, usually about two months ahead. Next, you pay the redemption sum on the redemption date. Finally, your lawyer lodges the discharge with the Singapore Land Authority (SLA).

If you used CPF savings for the property, the CPF Board also holds a charge over it. Therefore, you must clear that charge as well before SLA releases your title.

Here are the five steps at a glance:

  1. Check your loan agreement for the notice period and any lock-in.
  2. Serve a redemption notice and ask the bank for a redemption statement.
  3. Apply to the CPF Board if you plan to repay with CPF savings.
  4. Pay the redemption sum on the redemption date.
  5. Lodge the discharge, and any CPF discharge, with SLA.

What Is Redemption and Discharge of Mortgage? #

Redemption of mortgage means repaying the outstanding balance of an existing housing loan to the bank, which the law calls the mortgagee. Discharge means something slightly different. There, the borrower has already repaid the loan in full, and the mortgagor now wants to remove the mortgage that remains registered against the property. Owners usually redeem or discharge for one of four reasons:

  • You are selling your property.
  • You are refinancing your loan to another bank.
  • You simply want to repay the loan early, before maturity.
  • You have fully paid up your loan.

After you redeem or discharge, the mortgagee executes a Total Discharge of Mortgage, often called TDM. Your lawyer then lodges that instrument with SLA. SLA in turn removes the mortgage from your title.

If you used CPF savings for the purchase, the CPF Board also holds a charge on the property. You may keep that charge or discharge it, and we explain both routes below.

Our Scope: Redemption of Mortgage for All Property Types, Including HDB Flats #

We act on the redemption or discharge of a mortgage for every property type in Singapore. That includes HDB flats. However, we do not currently handle the conveyancing for the sale, purchase, mortgage or refinancing of HDB flats.

When Is Redemption of Mortgage Required? #

Clients commonly instruct us in these situations:

  • Selling a property that carries a bank mortgage.
  • Refinancing from one bank to another.
  • Settling the loan in full before maturity.
  • Your mortgage loan has fully been paid up.
  • Discharging a CPF charge where you used CPF savings.

Our Scope of Work in a Redemption and Discharge #

When we act for you, our work usually covers the following steps:

  • We serve the redemption notice on your bank, then confirm the redemption sum and the completion date.
  • We liaise with the CPF Board, where applicable, to discharge the CPF charge.
  • We prepare the discharge documents and attend to their execution by the bank or the CPF Board.
  • We liaise with the mortgagee’s solicitors, or act for the bank where it appoints us.
  • We coordinate timelines with your sale, refinancing or other related transaction.
  • We check that every redemption sum is paid, then lodge the discharge with SLA.
  • We arrange collection of the original title, where one exists, after lodgement.

Afterwards, you or your authorised representative may collect the original hardcopy title, unless the title is suppressed.

Redemption Notice Periods and Penalty Interest #

Most Singapore banks expect about two months’ notice. Even so, the period varies with your loan agreement. Some banks want longer notice, while others accept less.

If you give short notice, the bank may charge penalty interest for the shortfall. Therefore, always check your Letter of Offer or facility agreement first. If in doubt, simply call the bank and confirm.

Many loans also carry a lock-in period. Consequently, an early redemption within that window may attract a prepayment penalty. Our guide on mortgage and refinancing explains these charges.

Redemption of Mortgage: Preliminary and Final Redemption Statements #

Borrowers often ask us about the two redemption statements. The difference matters, so we explain it early in every matter.

First, after your lawyer serves the redemption notice, the bank issues a preliminary redemption statement. It gives you an advance figure for the loan outstanding. However, it is only preliminary. It does not take account of the monthly instalments you must still pay before full redemption, and interest keeps running until the redemption date.

Then, on the redemption date itself, the mortgagee issues the final redemption statement. That statement shows the actual sum needed to redeem the mortgage on the day.

Why the two figures differ in a sale with redemption of mortgage #

Timing creates a practical problem when you sell a property that still carries a mortgage. Once the purchaser exercises the option, your lawyer serves the redemption notice at the relevant time. The bank then provides the preliminary redemption statement.

Your lawyer relies on that preliminary figure for two things. First, we prepare the completion account for you. Secondly, we serve the mode of payment on the purchaser’s lawyers, so that they know how to split the cashier’s orders on completion day. Condition 9.6 of the Law Society of Singapore’s Conditions of Sale 2020 sets the deadline. We must furnish the mode of payment at least seven clear Business Days before the Scheduled Completion Date.

That deadline carries a real sanction. If the vendor furnishes the mode of payment late, and the purchaser cannot complete on the Scheduled Completion Date as a result, the purchaser pays no interest for that delay. Moreover, the purchaser’s permitted delay cannot exceed the number of deficit days in the notice given.

At that point, nobody yet knows the final redemption figure. Therefore, the cashier’s order in favour of the bank is drawn for the preliminary amount, not the final amount. Meanwhile, you keep paying your monthly instalments, and those payments reduce the loan further.

Consequently, the preliminary figure is commonly higher than the final figure. In a sale, the bank therefore quite often receives more than it is actually owed.

Getting the excess back after redemption of mortgage #

You do not lose that excess. We ask the bank to refund the overpayment to you, usually by crediting your account with the same bank, or by another mode of refund that you agree with the bank.

Using CPF Funds to Redeem Your Housing Loan #

You may repay the outstanding loan with your CPF savings. First, you or your lawyer serve the redemption notice on the bank, usually at least two months ahead. The bank calls the final payment date the redemption date.

Next, apply to the CPF Board to remit the loan amount to the bank. As a rule, aim for 7 working days before the redemption date. Bank policies do vary, so confirm the timing with your bank.

Timing matters here. If your CPF funds reach the bank too early, say a month ahead, the bank may reject the payment. It would then return the money to your CPF account. Therefore, always follow the bank’s instructions.

The application also differs between an HDB loan and a bank loan. For the current steps, see the CPF Board guidance on repaying a housing loan. If that page moves, please search the CPF Board website for the latest version.

Redemption of Mortgage and the CPF Charge: Keep It or Discharge It? #

A CPF charge arises whenever you withdraw CPF savings for the property. It secures the refund of the principal withdrawn, together with the accrued interest. Importantly, a redemption of mortgage does not remove that charge on its own.

You therefore have a choice. You may discharge the CPF charge as well, or you may leave it in place. If you do want it discharged, you must first refund the CPF Board the principal withdrawn plus the accrued interest.

  • Keep the CPF charge – no refund falls due and no discharge of the CPF charge is needed, but the title stays suppressed.
  • Discharge the CPF charge – refund the principal and accrued interest to the CPF Board, and the charge comes off the title.

In practice, most mortgagors keep the CPF charge. They redeem or discharge the mortgage only, so no refund arises. Consequently, the matter stays simpler and cheaper. Where the property carries no CPF charge at all, none of this applies.

Getting Your Title Deed Back After a Redemption of Mortgage #

SLA prints and releases a hardcopy title only when the property carries no mortgage, no CPF charge and no other charge. The CPF charge arises when you withdraw CPF savings for the property. It secures the refund of the principal withdrawn, plus accrued interest, on a later sale.

So, while any charge remains, the title stays suppressed. SLA therefore provides no physical or hardcopy title when we lodge the Total Discharge of Mortgage. To clear the CPF charge instead, you must instruct lawyers to apply for its discharge and refund the CPF savings used, together with accrued interest.

Furthermore, the CPF Board’s charge ranks ahead in priority. Therefore, where you keep that charge, your lawyers must first obtain the CPF Board’s authority in SLA’s prescribed form before they can lodge the TDM. We make that application for you. If the property carries no CPF charge, this issue simply does not arise.

Most titles today are digital rather than paper. Our guide explains how to obtain a digital title of your Singapore property.

Redemption of Mortgage Where the Borrower Is a Company #

Where a company owns and mortgages the property, ACRA also records the mortgage as a company charge. Two extra steps then follow:

  • We prepare the discharge form, such as a Lodgement of Satisfaction of Charge, for the bank and the company to execute.
  • We lodge either a total satisfaction, for a full redemption, or a partial satisfaction, where only part of the debt or security falls away.

That lodgement belongs at ACRA, after the redemption completes. Otherwise, the company’s public records stay out of date. In turn, that can hold up future financing or a sale.

Costs to Expect in a Mortgage Redemption #

Besides our legal fees, you should budget for:

  • The bank’s administrative or discharge fee.
  • The CPF Board’s legal fees, where a CPF charge needs discharging.
  • SLA lodgement fees for the discharge.
  • ACRA lodgement fees, where the borrower is a company.

Frequently Asked Questions About Redemption of Mortgage #

What is a redemption notice? #

A redemption notice is a formal notice to your bank. In it, you state your intention to repay the loan in full. You also ask for a redemption statement for a specific completion date.

How much notice must I give to redeem my loan? #

Two months is the usual expectation in Singapore. However, your loan agreement governs, so check it first. Short notice may attract penalty interest for the shortfall.

What is a discharge of mortgage in Singapore? #

A discharge of mortgage removes the bank’s registered charge from your property. In everyday practice, discharge describes the position where you have already repaid the loan in full and now want the mortgage taken off the title. Your bank executes a Total Discharge of Mortgage, and your lawyer then lodges it with SLA.

What if I used CPF funds to buy my property? #

Then a CPF charge also sits on your property. You may keep that charge or discharge it. If you keep it, no refund falls due, although SLA keeps the title suppressed. If you discharge it, you must refund the CPF Board the principal withdrawn plus the accrued interest.

Can the same lawyer act for me and my bank in a redemption of mortgage? #

Often yes. Where our firm sits on the bank’s panel, and no conflict of interest arises, we can act for both sides. As a result, you may save costs, because one firm handles the paperwork.

What are the costs involved in a mortgage redemption in Singapore? #

Expect our legal fees, the bank’s discharge fee and SLA lodgement fees. Where CPF is involved, add the CPF Board’s legal fees. Companies also pay ACRA lodgement fees. Ask us for a quote before you serve notice.

How long does a redemption of mortgage take? #

Plan for about two months, largely because of the notice period. The discharge itself follows soon after the redemption date. Registration at SLA then updates your title.

Do you handle redemption of mortgage for HDB flats? #

Yes. We act on redemption and discharge for every property type, including HDB flats. However, we do not handle HDB conveyancing for a sale, purchase, mortgage or refinancing.

What happens if I redeem during the lock-in period? #

Your bank may charge a prepayment penalty. The amount depends on your Letter of Offer. Therefore, check those terms before you fix a redemption date.

What is the difference between redemption and discharge of a mortgage? #

Redemption means repaying an existing mortgage loan so that the bank releases its security. Discharge, by contrast, applies once the loan has already been fully repaid, and the mortgagor simply wants the registered mortgage removed. In both situations, your lawyer lodges a Total Discharge of Mortgage with SLA.

Must I discharge the CPF charge when I redeem my mortgage? #

No. You may keep the CPF charge, and most mortgagors do exactly that. If you would rather remove it, you must refund the CPF Board the principal withdrawn together with the accrued interest.

Why is my title still suppressed after a redemption of mortgage? #

Because a charge still sits on the property. While any charge remains, including a CPF Board charge, SLA suppresses the title. SLA therefore issues no physical or hardcopy title when we lodge the TDM.

What is an AFS and why do my lawyers need one? #

An AFS is the authority, in SLA’s prescribed form, that the CPF Board gives so your lawyers may lodge an instrument such as the TDM. The CPF Board’s charge ranks in priority, so its authority is required wherever that charge remains. Where the property carries no CPF charge, no AFS is needed.

What is a preliminary redemption statement? #

The bank issues it after your lawyer serves the redemption notice. It gives an advance figure for the loan outstanding. However, it leaves out the instalments you must still pay and the interest that keeps accruing until the redemption date.

What is a final redemption statement? #

The mortgagee issues it on or about the redemption date. It sets out the exact sum needed to redeem the mortgage on that day, so your lawyer uses it to check the payment made and any refund due.

Why is the preliminary redemption amount higher than the final amount? #

Because the preliminary figure ignores the instalments you pay between the statement and completion. Meanwhile, those payments reduce the loan. Consequently, the final figure usually comes in lower.

Why must the cashier’s order follow the preliminary figure? #

Condition 9.6 of the Law Society’s Conditions of Sale 2020 requires your lawyer to furnish the mode of payment at least seven clear Business Days before the Scheduled Completion Date. At that stage, the final redemption figure does not yet exist. Therefore, we use the preliminary figure for the cashier’s order in favour of the bank.

What happens to the excess paid to the bank on completion? #

We ask the bank to refund it to you. Banks usually credit the overpayment to your account with them, although you may agree another mode of refund.
