Can I change my minor child’s name or surname by Deed Poll if I have sole custody?

No. Under the Immigration & Checkpoints Authority (ICA)’s current requirements, both parents’ consent is generally required for changing the name of a minor child under 21, even if one parent has sole custody.

A sole custody court order does not give the parent the automatic right to change the child’s name or surname. ICA considers both parents legal guardians unless a specific court order permits the name change or exceptional circumstances apply.

If the other parent is:

  • Uncontactable, or
  • Uncooperative, or
  • Absent from the child’s life,

you may still proceed with executing the Deed Poll, but ICA may not accept the name change unless:

  1. You provide a court order expressly granting permission to change the child’s name; or
  2. You contact ICA on your scenario.

ICA evaluates such cases on a case-by-case basis, and approval is not guaranteed.

Does a court order for sole custody mean I can change my child’s name? #

No. A sole custody order alone is not sufficient. According to ICA policy:

  • Both parents’ consent is still required unless:
    • A court order specifically authorises the name change, or
    • ICA exercises discretion to allow the change in exceptional situations.

What if my divorce order allows me to specifically change my child’s name? #

If your divorce final judgment or court order explicitly states that you are authorised to change your child’s name, this may be accepted by ICA in place of the other parent’s consent.

You will need to submit a certified true copy of the court order along with the Deed Poll for your child and other supporting documents.

What documents will ICA require to process a minor’s name change? #

You will typically need:

  • The original Deed Poll;
  • Your child’s birth certificate;
  • Your NRIC or passport;
  • A completed ICA Declaration Form signed by both parents;
    Download ICA Declaration Form (PDF)
  • If the other parent cannot be contacted:
    • Any relevant court orders permitting the name change.
